LEGAL ALERT – OHIO PAID SICK DAYS BALLOT ISSUE
Because of the inaction of the Ohio General Assembly, the Ohioans for Healthy Families coalition has begun to seek the additional 120,683 signatures required to force the issue of Paid Sick Days to the ballot in the November election. The proposed Ohio Healthy Families Act would enact Chapter 4114 of the Ohio Revised Code to require employers of more than 25 employees to provide employees working more than 30 hours with seven (7) paid sick days, that can be carried over from year to year. In addition, employees working less than 30 hours would also be eligible to accrue prorated sick time. Of critical concern for our private employer clients is language in the law that “employers may not reduce or eliminate any leave in existence at the time of the Act's enactment regardless of the type of such leave in order to comply with the Act.” Furthermore, conflicting language and notice requirements between this proposed law and existing state and federal statues will cause additional administrative costs to handle associated paperwork for notices, leave verification and record retention.
